Modifies provisions relating to proceedings resulting from criminal conduct

HB 1115 modifies Missouri's criminal trial procedures for first-degree murder cases and establishes automatic record sealing for eligible convictions. For murder trials where the death penalty is not waived, it requires a two-stage process: first determining guilt, then assessing punishment (with life without parole mandated if intellectual disability is proven, aggravating factors are absent, or a jury cannot unanimously agree on death). The bill also creates "automated expungement" for certain misdemeanor and felony records after 1-3 years of clean criminal history (or at age 65), excluding juvenile cases and traffic offenses, effective August 2028. These changes apply to offenses committed on or after August 28, 2001, for trial procedures, and to records maintained after August 2028 for expungement.
