SF 969 Minnesota Senate · 2025-2026 Regular Session

Subsurface drain tile disclosure requirement

SF 969 requires sellers of Minnesota agricultural or rural property (classified as tax class 2a or 2b) to disclose the location and status of subsurface drain tile systems to buyers before closing. Sellers must provide either a written statement confirming no drain tile is known to exist or a detailed disclosure including legal descriptions, maps showing tile location/diameter/outlets, and drainage paths. The disclosure must be included in the deed or accompanied by a certificate, with a $50 fee paid to the county recorder. The county must forward copies to the Board of Water and Soil Resources, effective January 1, 2026. This directly affects real estate transactions involving farmland or similar properties.
