Trade: consumer goods and services; compensation for overcharged items; increase. Amends secs. 9 & 12 of 2011 PA 15 (MCL 445.319 & 445.322).
HB 5137 updates Michigan's retail pricing law to better compensate shoppers who are accidentally overcharged. It requires retailers to pay customers the difference between the displayed price and the charged price, plus 10 times that difference (minimum $10, maximum $50 per item) within 2 days after a customer notifies them of the error. This applies to retail transactions with displayed prices, receipts, and automatic checkout systems, but excludes intentional overcharging. The law also sets a 2028 inflation adjustment for compensation amounts using the Detroit Consumer Price Index.
