Property: other; alternate procedure to evict squatters; provide for. Amends sec. 5714 of 1961 PA 236 (MCL 600.5714) by adding sec. 5712.
This bill creates a new legal process allowing property owners to quickly remove individuals who are unlawfully occupying their residential homes without going through a standard court eviction hearing. Under the new procedure, an owner or their agent can submit a sworn complaint to the county sheriff detailing specific conditions, such as confirming the occupant is not a tenant, family member, or current owner. If the sheriff verifies the complaint, they must immediately serve a notice to vacate and can assist the owner in changing locks and removing personal belongings, with the owner responsible for paying the sheriff's standby fee. The law also establishes that anyone wrongfully removed using this process can sue for damages, including triple the fair market rent, while noting that owners remain liable if they make false statements in their complaint.
