An Act relative to direct food donations

This bill amends Massachusetts law to protect food service businesses and retail stores from civil lawsuits when they donate food directly to individuals at no cost or only to cover handling fees. The protection applies to food that is not misbranded, adulterated, or stored in violation of health regulations, provided the donor did not act negligently, recklessly, or intentionally. By removing liability for injuries caused by the condition of donated food, the legislation aims to encourage more direct food donations to individuals in need.
