An Act relative to motor vehicle leasing parity
This bill establishes a "lemon law" protection for consumers who purchase or lease used motor vehicles in Massachusetts that fail to pass state safety or emissions inspections within seven days. It allows buyers and lessees to void the contract or lease if the vehicle has defects not caused by their operation or an accident, provided the cost to fix those defects exceeds ten percent of the purchase price or total lease payments. To exercise this right, the consumer must notify the dealer within fourteen days, return the vehicle, and provide a written inspection report detailing the failures and repair costs. The law specifically applies to vehicles used for personal or family purposes and defines a lessee as someone with a lease term of at least one year.
