An Act relative to level-three sex offender residency restrictions
This bill allows Massachusetts cities and towns to vote on whether to ban adult Level 3 sex offenders from living within 1,500 feet of schools, day-care centers, parks, or public recreational facilities. If a community chooses to adopt these restrictions, offenders currently residing within the prohibited zone would have 30 days to move to a new location that is not within the restricted distance. The law also clarifies that new developments, such as a newly built school, do not violate the rule if they are constructed within 500 feet of an offender's existing home. Additionally, each day an offender remains in violation after the initial notice period counts as a separate offense. This legislation gives local communities the authority to enforce these zoning rules while defining specific distances and consequences for non-compliance.
