An Act relative to health care proxies
This bill amends Massachusetts laws regarding health care proxies to restrict who can be appointed as a health care agent for an incapacitated person. It prohibits naming an agent if that person is currently under investigation or has been convicted of crimes involving serious bodily injury or neglect against the principal. Additionally, the bill expands the legal grounds for removing an agent by including situations where the agent is partly responsible for causing the principal's incapacity. The Department of Public Health, along with medical and nursing registration boards, will create regulations to enforce these new restrictions.
