An Act relative to visitation and family court matters in domestic violence cases
This bill requires criminal courts in Massachusetts to automatically issue a ban on visitation for defendants charged with specific violent crimes against pregnant people or children. The restriction applies during the pretrial period and, upon conviction, for all or part of the defendant's sentence, unless the victim or an involved child waives the ban. If a defendant is acquitted or the case is dropped, the visitation ban is immediately lifted. Additionally, the bill prevents defendants from filing motions to establish paternity or request genetic testing until the visitation ban is removed.
