H 5002 Massachusetts House · 193rd Legislature (2023-2024)

An Act establishing the recall of elected officials in the town of Williamstown

This bill amends the charter of Williamstown to allow voters to remove elected officials, including vocational school district representatives, through a formal recall process. To initiate a recall, at least 200 voters must sign a petition stating the grounds for removal, and if 10 percent of registered voters sign it, a recall election must be held between 64 and 90 days later. If a majority of voters approve the recall, the official is immediately removed from office, and the resulting vacancy is filled by a candidate who serves until the next regular town election. The law also includes safeguards, such as a 270-day waiting period before a non-recalled official can face another recall petition and restrictions on appointing recalled officials to new boards for two years.
