An Act relative to fentanyl arrests (Tatiana's Law)
This bill, known as Tatiana's Law, restricts bail for adults arrested for manufacturing, selling, or distributing fentanyl in Massachusetts. It requires that such individuals be held for at least six hours after arrest before they can be released on bail, unless a judge makes an exception in open court. Additionally, the law prevents court clerks or bail commissioners from releasing these defendants outside of a courtroom setting. Before granting bail or setting conditions, officials must have immediate access to the individual's criminal history and relevant police reports to assess safety risks.
