An Act establishing a pilot diversion program for individuals with developmental and intellectual disabilities

This bill creates a five-year pilot program in Boston municipal courts to divert adults with intellectual or developmental disabilities away from prosecution and incarceration. Under the plan, eligible individuals who have a medical diagnosis and are charged with non-violent offenses can receive treatment and support services instead of facing criminal penalties. The Massachusetts Probation Service and the Department of Developmental Services will jointly manage the program and provide free care, assessments, and services to participants. Additionally, the agencies must submit annual reports to state officials and the public detailing the number of people diverted, program costs, and participant outcomes.
