An Act to ensure access to generic medication

This bill amends Massachusetts law to regulate how pharmacy benefit managers and insurance companies set reimbursement limits for generic drugs. It requires that any drug placed on a cost list must be proven to have multiple generic alternatives available and must remain on that list only as long as it meets these availability standards. The legislation also mandates that these cost lists be updated frequently and made available to pharmacies, while giving pharmacies a formal process to appeal if the set reimbursement amount is too low to cover their actual acquisition costs.
