AN ACT relating to digital learning. Create new sections of KRS Chapter 160 to establish the Digital Learning and Workforce Development Pilot Project and identify the program's purposes; define terms; provide the methods for creation of virtual school programs under the Digital Learning and Workforce Development Pilot Project; require a local board of education authorizing a virtual school project to adopt certain policies necessary for the governance of the project; establish a process for a virtual school project to allow enrollment of nonresident students and the procedures for a parent to enroll a nonresident student into the program; establish certification requirements for certified staff employed by the program; allow a local board of education to determine how a resident student enrolled in the program may participate in the district's extracurricular activities; set instructional time requirements; set academic content, assessment, and accountability requirements for the program; allow an authorizing board to contract for education services; authorize and provide guidance for the Kentucky Board of Education to promulgate administrative regulations to calculate a program's average daily attendance; provide procedures for an authorizing board to address a student enrolled in a program who fails to respond to assignments and directives; exempt students enrolling and participating in a program from certain requirements regarding attendance and physical presence; amend KRS 157.350 to allow a district to count a nonresident pupil who attends a virtual school program in the district's average daily attendance.
