SSB 1124 Iowa Senate · 2025-2026 Regular Session

A bill for an act relating to the establishment or modification of legal custody of a child.

This bill (SSB 1124) changes how Iowa courts handle legal custody decisions for children. It allows courts to award parents "separate rights and responsibilities" under joint legal custody - meaning each parent might make different decisions about the child's life (like education or healthcare) - while both retain access to the child's information. The bill also creates a new process for resolving custody disputes: parents must file an application with the court, and the court must determine if proposed changes would alter the child's "established custodial environment" (a stable relationship with a parent or caregiver). If the change would disrupt this environment, the proposing parent must prove it is in the child’s best interest with "clear and convincing evidence"; otherwise, a lower "preponderance of evidence" standard applies. The bill requires courts to consider standard custody factors but only explain why a factor doesn’t apply if it’s not relevant.
