DOMESTIC VIOLENCE ORDER-EFFECT

Amends the Stalking No Contact Order Act, the Civil No Contact Order Act, and the Illinois Domestic Violence Act of 1986. Provides that on issuance of a plenary order, the emergency order remains in effect until the plenary order or short form notification is served on the respondent.

INC TX-FOSTER CARE

Amends the Illinois Income Tax Act. Creates an income tax credit in an amount equal to the foster care expenses, not to exceed $1,000 in any taxable year, paid or incurred by the taxpayer with respect to a qualified dependent child. Provides that the credit may be prorated. Provides that the credit is refundable if the taxpayer's federal adjusted gross income for the taxable year does not exceed $50,000. Effective immediately.

CRIM PRO-PHONE CALLS-CONTACT

Amends the Code of Criminal Procedure of 1963. In a provision which specifies that a person who is in police custody shall have the right, upon being taken into police custody, to communicate free of charge with an attorney of his or her choice and members of his or her family, deletes a provision that required that right to be provided as soon as possible upon being taken into custody. Provides that, if a person who is in police custody is transferred to a new place of detention, that person has a right to make one telephone call (rather than 3 telephone calls) within 3 hours of arrival. Specifies that this right is not renewable. Provides that the person in police custody is prohibited from contacting the alleged victim or victims of the offense for which the person is charged. Provides that statements that are made by a person who is detained in police custody in violation of the right to communicate provisions of the Code may be used to evaluate whether those statements were voluntarily given and are reliable, based on the totality of the circumstances. Authorizes a custodial arrest of a person accused of an offense that is not a felony or Class A misdemeanor if necessary to verify the accused's identity.

MOBILE ID CARDS & LICENSES

Amends the Illinois Identification Card Act. Changes references from "electronic credential" to "mobile identification card". Provides that no relying party, including law enforcement, may take physical possession of a mobile identification card holder's mobile device for purposes of verifying the mobile identification card holder's identity. Amends the Illinois Vehicle Code. Inserts conforming provisions concerning requirements for mobile driver's licenses. Makes other changes.

ASSISTED LIVING-CNA TRAINING

Amends the Assisted Living and Shared Housing Act. Provides that the Department of Public Health shall allow assisted living establishments and supportive living establishments to provide an approved course of training for certified nursing assistants at the establishment, so long as the training meets the requirements of the Nursing Home Care Act and rules adopted by the Department. Sets forth provisions concerning the supervised clinical training portion of the training program. Provides that the Department shall adopt rules requiring that the Health Care Worker Registry include information identifying where an individual received clinical training and may amend specified rules as necessary to implement the certified nursing assistant training program.

EDUC-FOREIGN LANG ALTERNATIVE

Amends the Courses of Study Article of the School Code. Provides that, as a prerequisite to receiving a high school diploma, each pupil entering the 9th grade beginning with the 2028-2029 school year must successfully complete either 2 years of foreign language courses or at least 2 years of career-focused coursework that has been authorized by the State Board of Education as meeting the requirements for a College and Career Pathway Endorsement under the Postsecondary and Workforce Readiness Act (rather than requiring the successful completion of 2 years of foreign language courses). Amends various Acts relating to the governance of public universities in Illinois. Provides that a public university may not require State public high school graduates, as a condition of acceptance, to have completed any years of foreign language courses unless the university permits, as an alternative to completion of a foreign language course, attainment of a College and Career Pathway Endorsement under the Postsecondary and Workforce Readiness Act. Effective immediately.

CRIM PRO--SPEEDY TRIAL TOLL

Amends the Code of Criminal Procedure of 1963. In a provision concerning the prosecution of a person for an offense of criminal sexual assault, predatory criminal sexual assault of a child, aggravated criminal sexual assault, criminal sexual abuse, aggravated criminal sexual abuse, aggravated battery, or aggravated domestic battery, deletes a provision which states that there is a rebuttable presumption that the testimony of a victim who is a child under 13 years of age shall occur outside the courtroom and the child's testimony shall be shown in the courtroom by means of a closed circuit television. Deletes that this presumption may be overcome if the defendant can prove by clear and convincing evidence that the child victim will not suffer severe emotional distress. Provides that, if the court denies the State's request for the child victim's testimony to be taken outside the courtroom, the court shall toll the speedy trial requirements for 30 days to allow the State to present the motion to the court again before trial requesting the child's testimony to be taken outside the courtroom by means of a closed circuit television.

ETHICS COMM-INVESTIGATIONS

Amends the State Officials and Employees Ethics Act. Provides that the Legislative Ethics Commission shall adopt no rule requiring the Legislative Inspector General to seek the Commission's advance approval before issuing a subpoena. Provides that any existing rule, as of the effective date of the amendatory Act, requiring the Legislative Inspectors General to seek the Commission's advanced approval before issuing a subpoena is void. Provides that within 60 days after receipt of a summary report and response from the ultimate jurisdictional authority or agency head, the Executive and Legislative Ethics Commissions shall make available to the public the report and response or a redacted version of the report and response (currently, report required to be made public only if it resulted in a suspension of at least 3 days or termination of employment). Removes language providing that the Legislative Inspector General needs the advanced approval of the Commission to issue subpoenas. Makes conforming changes. Effective immediately.

TELECOMMUNICATIONS THEFT

Amends the Recyclable Metal Purchase Registration Law. Provides that it is a violation of the Act for any person to possess, purchase, attempt to purchase, sell, or attempt to sell, or for any recyclable metal dealer to purchase or attempt to purchase, telecommunications wire in any amount unless the seller is an authorized agent, a representative or employee of a licensed contractor of a public utility, a provider of telecommunications services, as described in the Public Utilities Act, or a provider of broadband service, interconnected VoIP services, or wireless services, as described in the Public Utilities Act. Provides that the Recyclable Metal Theft Task Force shall review the effectiveness of its efforts in deterring and investigating the problem of recyclable metal theft specific to telecommunications wires, burned wire, and any other equipment used to provide (i) telecommunications services, as described in the Public Utilities Act, or (ii) broadband service, interconnected VoIP services, or wireless services, as described in the Public Utilities Act. Provides that the Task Force shall consider and develop long-term solutions, both legislative and enforcement-driven, for the rising problem of theft of these wires and equipment in this State. Provides that the Task Force shall be composed of one representative of a wireless telecommunications carrier. Provides that the Task Force shall, by October 31 of each year, report its findings and recommendations to the General Assembly and the Governor. Changes the definition of the term "recyclable metal". Defines the terms "burned wire" and "telecommunications wire".

REPEAL PA 103-653-CONVEYANCE

Repeals Public Act 103-653, which authorized the Adjutant General to convey certain real property in Franklin County, Illinois. Effective immediately.
