Summary
Amends the Name Change Article of the Code of Civil Procedure. Provides that for a petition for name change by a person who is required to register under Sex Offender Registration Act, the Murderer and Violent Offender Against Youth Registration Act, or the Arsonist Registration Act and not yet pardoned, if the petition alleges that it is sought because of marriage, religious beliefs, status as a victim of trafficking or gender-related identity, the court may grant or deny the petition after making a determination based on certain factors. Provides that any denial of a name change to these individuals must be in writing demonstrating the reasons for the denial. MINOR
The bill updates the rules for name changes involving sex offenders and convicted felons. It clarifies that individuals with pending charges requiring registration cannot file for a name change until pardoned. It also mandates that if a name change is granted to a convicted felon, the court must send the order to the Illinois State Police to update criminal records and offender registries.
Scope change
The bill expands the scope by adding specific requirements for the Illinois State Police to update offender registries when a name change is granted to a convicted felon, whereas previous versions did not explicitly detail this notification process.
ENFORCEMENT
Requires the court to forward a copy of the name change order to the Illinois State Police for convicted felons so their criminal history and offender registration records are updated with the new name.
REQUIREMENT
Adds a specific requirement for courts to have a court reporter present during interviews with children regarding name changes to ensure an official record is made.
Reorders and expands the list of factors courts must consider when determining the best interest of a minor child in a name change petition.
