MODERATE
This bill updates the rules for design-build projects in Illinois counties, municipalities, and fire protection districts. It raises the dollar threshold for small contracts and clarifies that a design-build firm cannot be disqualified just because they have worked on similar projects before. Additionally, it allows counties to proceed with a single bidder for the second phase of a project if they determine it is in their best interest.
Scope change
The bill applies to the Counties Code, the Illinois Municipal Code, and the Fire Protection District Act, covering design-build procurement processes across local governments.
REQUIREMENT
Raised the maximum estimated basic professional services fee threshold for small contracts from $25,000 to $40,000 for contracts entered into between now and January 1, 2027.
Added discretion for counties to proceed with a Phase II evaluation using a single respondent if the county finds it in their best interest.
Removed specific language requiring the development of preliminary design plans in the request for proposal for design-build projects.
Added provisions stating that competitive bidding rules do not prohibit fire protection districts from entering into design-build contracts.
ELIGIBILITY
Clarified that a design-build entity cannot be disqualified solely based on having previously been awarded projects under public procurement statutes.
