MODERATE
The bill was finalized as an Enrolled version, incorporating specific policy changes to improve access for incarcerated individuals with intellectual or developmental disabilities. Key updates include clarifying the definition of 'program' to cover various rehabilitation activities, adjusting the timeline for waiver decisions from 45 to 60 days, and shifting responsibility for submitting disability documentation to the individuals themselves rather than the Department.
Scope change
The bill's scope was expanded by explicitly defining 'program' to include behavioral modification, life skills, reentry planning, and other specific activities, ensuring these individuals can access a broader range of rehabilitation opportunities.
DEFINITION

Added a specific definition for 'Program' to list behavioral modification, life skills, reentry planning, Correctional Industries, substance use, educational, career and technical education, self-improvement, vocational, clinical service, approved volunteer activities, and work assignments.

TIMELINE

Extended the deadline for the Department to decide on a waiver request from 45 days to 60 days.

REQUIREMENT

Changed the requirement for documentation so that the incarcerated individual is now responsible for submitting proof of disability, rather than the Department making a determination based on available records when documentation is missing.

Updated the notice the Department must provide to include the impact of a waiver on eligibility for 'earned program sentence credit' instead of just 'earned sentence credit'.

Revised the list of acceptable documentation to remove the option for the Department to use available records if verifying documentation is unavailable, instead requiring the individual to submit information for review.

Changed the text regarding sentence credit to refer to 'earned program sentence credit' instead of 'earned sentence credit' to align with the new program definition.
