MODERATE
This bill updates requirements for accessible parking spaces, shifting the focus from 'parking lots' to 'parking facilities' to include covered structures like garages. It simplifies the rules by replacing complex tiered calculations with a single minimum of one accessible space per facility, while mandating that at least one of those spaces be van-accessible for smaller facilities. The update also adds an exemption for large public entities that already meet federal ADA design standards.
Scope change
The bill's scope expanded from applying only to 'parking lots' to applying to all 'parking facilities,' which likely includes garages and other covered structures.
REQUIREMENT
Changed the terminology from 'parking lots' to 'parking facilities' to broaden the application to include garages and other covered structures.
Replaced a complex tiered system with specific numbers of accessible spaces for different lot sizes with a simplified rule requiring at least one accessible space for facilities with 1-25 spaces, and at least one van-accessible space within that minimum.
Updated the penalty language to clarify that fines are 'no less than $250 nor more than $500' for each violation.
ELIGIBILITY
Added an exemption for public entities, including universities, that manage large parking inventories and are already compliant with federal ADA design standards.
