Committee Substitute 3 adds a new section (Section 21) amending s. 403.892 to exclude tall multifamily buildings from graywater technology incentives and clarify that owner-occupancy is not an eligibility requirement. It also revises setback distances for onsite sewage systems near public potable wells by differentiating based on the size of the establishment served (200 feet for larger establishments over 2,000 gallons per day; 100 feet for smaller ones at or under 2,000 gallons per day). The Committee on Fiscal Policy was added as a co-sponsoring committee.
ELIGIBILITY

New Section 21 amends s. 403.892 to exclude multifamily projects with building height greater than the maximum allowed under s. 125.01055 or s. 166.04151 (more than five stories) from graywater technology development incentives.

New Section 21 clarifies that whether a dwelling is owner-occupied is not an eligibility criterion for developers or homebuilders to receive graywater technology incentives under s. 403.892.

REQUIREMENT

Setback requirements in s. 381.0065(4)(f) for onsite sewage systems permitted before June 21, 2022 were revised: the 200-foot setback from a public potable well now applies only to establishments with total sewage flow greater than 2,000 gallons per day, and a new 100-foot setback was added for public potable wells serving establishments with total sewage flow of 2,000 gallons per day or less.

SCOPE

The Committee on Fiscal Policy was added as a co-sponsoring committee alongside the Appropriations Committee on Agriculture, Environment, and General Government, the Committee on Environment and Natural Resources, and Senator Massullo.
