Unlawful Restrictions in Land Records Emergency Act of 2024
This bill allows homeowners and homeowner associations in the District of Columbia to remove unlawful restrictive covenants from property deeds and governing documents by filing a simple amendment form with the Recorder of Deeds. It defines unlawful restrictions as clauses that limit property use based on race, color, religion, national origin, sex, familial status, disability, or other personal characteristics, as well as those violating local or federal laws. Under the new rules, individual owners can file their own amendments to clear their specific properties, while associations can remove such restrictions from their governing documents without needing a member vote. Additionally, the act declares void any covenants that prohibit apartment buildings or multi-unit dwellings when such structures are otherwise permitted by zoning laws.
