AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO TRANSPORTATION OF PUPILS.
What changed between versions
New subsection (a) grants the Department of Education authority to make rules and regulations concerning transportation of students in public elementary and secondary schools. This is a significant expansion beyond the original amendment, which only addressed nonpublic school transportation.
The boundary limitation for nonpublic, nonprofit school students (transportation only within public school district boundaries) was retained but reworded from 'shall only be entitled to' to 'are entitled to...only within,' which is a minor stylistic change with the same practical effect.
The provision stating that out-of-district transportation for nonpublic, nonprofit school students is required in accordance with IDEA, Section 504 of the Rehabilitation Act, or any other State or federal law was deleted entirely. This removes the explicit federal legal hook that previously justified out-of-district transport.
New provision stating that all rules and regulations for nonpublic, nonprofit school transportation shall be the same as those applicable to public schools, establishing parity between the two types of schools.
The term 'pupils' was changed to 'students' throughout the section, broadening the language to be more inclusive and consistent with modern usage.
