Spousal Maintenance Guidelines
Summary
Current law requires a party petitioning the court for dissolution of marriage or legal separation (petition) to disclose to the court the existence of any prior temporary or permanent restraining orders and civil protection orders, any mandatory restraining orders and protection orders, and any emergency protection orders entered against either party within 2 years prior to the filing of the petition. The act extends the time frame for the disclosure of any orders entered to within 5 years prior to the filing of the petition. In a proceeding for spousal maintenance, current law requires the court to consider a list of relevant factors. The act adds to the list of factors whether a spouse has engaged in domestic violence, coercive control, economic abuse, litigation abuse, emotional abuse, physical abuse, or unlawful sexual behavior against the other spouse. MINOR
This bill was amended to expand the definition of financial abuse in domestic violence cases by adding eight specific types of financial exploitation, including stealing resources, preventing access to money, and exploiting powers of attorney. The changes aim to better protect victims by ensuring courts recognize a broader range of financial control tactics as forms of domestic violence.
Scope change
The bill's scope was expanded to include more specific financial abuse behaviors that were previously not explicitly listed.
DEFINITION
Added eight new categories of financial abuse behaviors including stealing economic resources, using credit without authorization, preventing attendance at school or employment, exploiting resources for personal gain, withholding necessities like food and shelter, causing financial dependency, exerting undue influence over financial decisions, and threatening to expose immigration status.
REQUIREMENT
Modified the disclosure requirements for domestic violence restraining orders to include these newly defined financial abuse behaviors in court filings.
