What changed between versions
Cognitive impairment is now weighed equally with physical impairment when determining functional difficulty, and cognitive needs are explicitly defined to include prompting, monitoring, and supervising daily activities.
Preadmission screening must be conducted telephonically or virtually unless in-person assessment is required or requested, with expanded notice requirements about accommodations under the Americans with Disabilities Act.
New provision allows providers to receive reimbursement from the state if the director determines an applicant should have been eligible based on the grievance process.
Preadmission screening is now made available to all persons applying to nursing care institutions, with the state bearing the cost, and detailed information must be provided to the public.
Effective date delayed from June 30, 2027 to June 30, 2028 for certain screening tool updates and staff training manual revisions.
