An Act relating to law enforcement requests for wireless device location information in emergencies; and providing for an effective date.

This bill, known as the Kelsey Smith Act, allows law enforcement agencies in Alaska to request the current or most recent location of a wireless device from carriers during emergencies where there is a risk of death or serious physical harm. To qualify for this information, an officer must submit a written request asserting a reasonable basis that the device belongs to someone in an ongoing emergency, and only individuals acting in an official capacity may make these requests. Wireless carriers are required to provide the location without delay and are granted immunity from lawsuits if they comply with the law in good faith, while the Department of Public Safety must maintain a database of carrier emergency contacts to facilitate these requests. The legislation also mandates that the department create regulations to set minimum qualifications for requesting officers, limit how the location data is used, and ensure records are kept for each request.
